Doyle Dennis Avery LLP Files Suit on Behalf of Emergency Room Physician

 
Doyle Dennis Avery LLP recently filed suit against MSH Partners, LLC D/B/A Baylor Scott & White Medical Center – Uptown in Dallas County on behalf of an emergency room physician. Prior to the retaliation, Doyle Dennis Avery LLP’s client worked for Envision Physician Services d/b/a West Village Emergency Physicians, PLLC (“Envision”) as an emergency room physician. Envision contracted with Baylor Scott & White to provide emergency room services at Baylor Scott & White Medical Center – Uptown. 
 
On July 13, 2022, Doyle Dennis Avery LLP’s client learned that a patient with monkeypox (“mpox”) was going to seek treatment at the emergency room. After learning of this, the nurses on staff at the hospital expressed concerns to Doyle Dennis Avery LLP’s client about exposure risks based on the PPE that was provided by the hospital and the hospital’s lack of policies and procedures regarding mpox. Doyle Dennis Avery LLP’s client reported that he reasonably believed the hospital was failing to take necessary precautions when treating patients suffering from infectious diseases at the hospital.        
 
Doyle Dennis Avery LLP’s client, as the emergency room physician, reported the concerns to the Chief Nursing Officer and the Chief Executive Officer. In response the Chief Nursing Officer dismissed Doyle Dennis Avery LLP’s client’s concerns and alleged that mpox was exaggerated by the media. Because of Doyle Dennis Avery LLP’s client’s safety reports regarding mpox, the client was removed completely from the schedule.       
 
In all, MSH Partners, LLC D/B/A Baylor Scott & White Medical Center – Uptown unlawfully terminated Doyle Dennis Avery LLP’s client because of his protected reports of violations of law and reports regarding patient safety concerns. This conduct violated the Texas Health and Safety Code. As such, Doyle Dennis Avery LLP’s client is entitled to actual damages, punitive damages, lost past and future wages, mental anguish, reputational harm, exemplary damages, attorney’s fees, and other penalties provided by law.
